Can you appeal a redetermination decision?

Yes, you absolutely can appeal a redetermination decision made by the Social Security Administration (SSA). If the SSA determines that you no longer qualify for disability benefits—whether due to medical improvement or non-medical factors like income or resources—you have the legal right to challenge that decision. Acting quickly and strategically can help protect your benefits while you go through the appeals process.

Understanding Redetermination Decisions
SSA conducts two types of redeterminations:
- Medical Redetermination (Continuing Disability Review - CDR): SSA evaluates whether your health has improved and if you still meet their definition of disability.
- Non-Medical Redetermination: SSA reviews your income, resources, and living arrangements, mainly for SSI recipients.
If SSA finds that you are no longer eligible, they will send you a Notice of Cessation explaining the reasons.
How to Appeal a Redetermination Decision
If you disagree with SSA’s findings, you can appeal in four levels:
- Reconsideration: A different SSA reviewer will evaluate your case. You can provide additional medical records and other evidence. This is the first and most important step.
- Hearing by an Administrative Law Judge (ALJ): If reconsideration is denied, you can request a hearing before an ALJ.
- Appeals Council Review: If the ALJ denies your claim, you can ask the Appeals Council to review the decision.
- Federal Court Review: If the Appeals Council also denies your claim, your final option is to file a lawsuit in federal court.
Important Deadlines
- 60 Days to Appeal: You must file your appeal within 60 days of receiving the notice.
- 10 Days to Continue Benefits: If you want to keep receiving benefits while your appeal is being reviewed, you must request continued payments within 10 days of the notice date.
If you miss these deadlines, you might lose your right to appeal—or have to restart the application process entirely.
How to Strengthen Your Appeal
- Submit Updated Medical Records: Show that your condition has not improved—or has worsened.
- Provide Doctor Statements: A detailed letter from your physician can clarify how your condition still limits your ability to work.
- Stay Compliant with Treatment: Demonstrating that you’re following prescribed care strengthens your case.
- Get Help from a Disability Attorney: Professional guidance ensures your appeal is filed properly and fully supported.
